Terms of Service

1. Service

TWG Insights ("Service") is an internal reporting dashboard operated by The Westen Group ("we", "us"). It aggregates advertising and analytics metrics from third-party platforms such as Meta Ads, Google Ads, Google Analytics 4, and Google Business Profile and displays them to authorized users.

2. Eligibility and Access

Access is provisioned by The Westen Group. There is no public signup. Accounts are for agency personnel and the specific clients we serve. You are responsible for keeping your login credentials confidential and for all activity that occurs under your account.

3. Acceptable Use

You agree not to:

Attempt to access data belonging to accounts you are not authorized to view.
Reverse engineer, scrape, or interfere with the Service.
Use the Service to violate any law or third-party right, including the terms of the underlying advertising platforms.

4. Third-Party Platforms

The Service reads data from third-party platforms (Meta, Google) on your behalf using credentials you or your account owner authorize. Your use of those platforms remains governed by their respective terms. We are not responsible for changes, outages, or data accuracy on those platforms.

5. Intellectual Property

The Service, including its design, code, and branding, is owned by The Westen Group. Reports generated from your own advertising data remain yours to use in the ordinary course of your business.

6. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Reporting metrics are provided for informational purposes and may differ from platform-native reporting due to API timing, attribution, or platform changes.

7. Limitation of Liability

To the maximum extent permitted by law, The Westen Group shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Service. Our aggregate liability for any claim relating to the Service will not exceed the fees you paid us, if any, in the twelve (12) months preceding the claim.

8. Termination

We may suspend or terminate access at any time, with or without notice, including if we believe the account has been misused or if our relationship with the underlying client ends. You may request termination of your account at any time by emailing us.

9. Governing Law

These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to conflict-of-law rules. Exclusive venue for any dispute lies in the state or federal courts located in Kentucky.

10. Changes

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above. Continued use of the Service after changes constitutes acceptance.
